UN Requests Ecuador to Compensate Victims of Trafficking and Labor Exploitation
Dra. Cristina Toral A.
The United Nations (UN) has called on Ecuador to compensate over 330 individuals affected by trafficking and labor exploitation in the abacá plantations of Furukawa Plantaciones. In 2021, the Ecuadorian judicial system acknowledged these cases of violations, pointing to both the company and the Ecuadorian state as responsible. However, a provincial court absolved the state of responsibility, a decision that is currently under review by the Constitutional Court. The UN emphasizes the need to implement more effective measures to prevent modern slavery and ensure fair and swift reparations for the victims.
UN human rights experts have underscored the importance for Ecuador to ensure justice and compensation for victims of modern slavery. This case represents a crucial opportunity for Ecuador to strengthen its legal framework against trafficking and ensure adequate compensation for those who have suffered these human rights violations. The situation in the abacá plantations has been classified as a serious violation of fundamental rights, including the right to equality, non-discrimination, prohibition of servitude, as well as the rights to health, housing, and education.
The UN has urged Ecuador to improve its effectiveness in preventing modern slavery, suggesting the implementation of regular and effective labor inspections, especially in sectors considered high-risk. Likewise, they have requested strong legal actions against Furukawa Plantaciones for the abuses committed, as well as the provision of adequate reparations for the victims.
